A Supplemental Needs trust is designed to benefit a person with a mental or physical disability. Rather than diminish the benefits provided by a governmental program, the trust enables the beneficiary to have an unlimited amount of assets in the trust that will not count towards calculating government benefits.
Unlike a traditional trust, the Supplemental Needs trust purpose is not to provide for the general welfare of the beneficiary, but to provide for “extras.” This type of trust states that the disabled person never has direct access to the assets, but is managed by the trustee.
